These Terms of Use set out the agreement between you and Course Creators Limited (trading as "The Digital Experts Kit", "DEK", "we", "us", or "our") regarding your use of our software platform and associated services under English or UK law.
The Digital Experts Kit includes, but is not limited to, the DEK software platform, templates, automations, data tracking tools, community groups, training, and any related services or content (collectively, the "Platform").
By using DEK in any way, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
These Terms include our Privacy Policy and any other documents referred to herein. Collectively, they govern all access to the Platform.
The Platform includes all web domains, subdomains, mobile apps, and any media or applications related to The Digital Experts Kit.
1. Introduction
Thank you for choosing The Digital Experts Kit. We offer an all-in-one marketing and business system to help you grow your online presence, including design templates, automation workflows, tracking tools, and strategy training ("Content"). By using our tools, services, community features, support, and Content, you are entering into a binding agreement with us.
2. Age of Access
You must be at least 18 years old to use DEK. By using the Platform, you represent and warrant that you are 18 years or older. We do not knowingly collect personal data from anyone under 18.
3. Account Registration
a. Account Holders: You must complete the account registration form with current, accurate information. Your email must be unique to you, and you must choose a secure password.
You agree not to:
- Register on behalf of another person or company
- Register using a false or alias identity
- Impersonate anyone else or misrepresent your relationship with an organisation
- Use credentials intended to deceive
b. Team Members: Account Holders may add Team Members to their account with unique logins. Team Members have no more access than granted by the Account Holder. The Account Holder remains fully responsible for all activities, including those of Team Members.
c. Security: We may suspend or terminate accounts where false information, password sharing, or unauthorised distribution of non-public Content occurs. You are responsible for all activities under your account. Notify us immediately of any security breach.
We may communicate via:
- Email to your registered address
- Platform dashboard notifications
- Notices elsewhere on the Platform
4. Pricing Plans & Trials
a. Plan Fees and Price Changes: Details of our annual and monthly plans are listed on our website. We may offer free or paid trials. Pricing and plan features may change with advance notice. Promotional pricing may be amended or terminated at our discretion. Price changes take effect on your next billing cycle.
If you purchased access using a code, gift card or prepaid offer, separate terms may apply.
b. Trial Period: We may offer free or paid trials. Your payment details must be submitted before a trial starts. If you do not cancel before the trial ends, you will be charged automatically for your selected plan. Free trials end at the date stated at registration and auto-renew unless cancelled.
c. Paused Plans: You may pause your plan and retain your account data. While paused, you cannot access your content and may be asked to disconnect domains or payment systems.
5. User Payments, Cancellations & Refunds
Important Legal Notice for UK Customers: Under the UK Consumer Contracts Regulations 2013, you may normally have a right to cancel within 14 days. However, by registering and accessing your DEK account immediately, you acknowledge that you are giving your express consent to begin the service during the cancellation period and agree to waive your statutory right to cancel. This waiver applies to all subscription types, including monthly plans.
a. Payments: At registration, you agree to our fees and billing schedule. You authorise us to charge your saved card automatically. You warrant that you have legal rights to use the card(s) on file. We share your details with our payment processors (e.g., Stripe or PayPal) as necessary. If payment fails, we may terminate your access and delete your content.
b. Cancellations: You may cancel your plan anytime. Cancellation is effective at the end of the billing cycle. You must download any content before cancellation. Your licence to use DEK ends on cancellation.
Please note that all cancellations are final and no refunds will be issued for any unused portion of your subscription. This applies to both monthly and yearly plans. All payments are non-refundable as outlined in our Refunds section above.
c. Refunds, Upgrades & Downgrades: Your satisfaction with The Digital Experts Kit is important to us. However, due to the nature of the services provided—which include access to digital software, templates, automations, training, and other instantly accessible content—we operate a strict no refund policy. By registering for and accessing your DEK account immediately, you provide your express consent to waive your statutory 14-day cancellation right under the Consumer Contracts Regulations 2013. This waiver applies to all subscription types, including monthly and yearly plans.
Accordingly, we do not offer refunds under any circumstances, including for cancellations, downgrades, non-usage, or change of mind. All sales are final, and no pro-rata refunds or credits will be issued once a payment has been processed.
You may upgrade, change your subscription, or downgrade your plan at any time. The cancellation will become effective at the end of the then-current billing cycle. If you wish to cancel, please ensure you download your contact data from the Platform before doing so.
Upgrades will result in a charge for the difference between your current plan and the upgraded plan.
Downgrades will not result in a refund. If downgrading from a more expensive to a less expensive plan or from a yearly to a monthly plan, a calculated credit may be applied to your DEK account based on the difference in service fees. Downgrading may result in loss of access to certain features, services, or data due to differences in plan tiers.
Refunds are not applicable to any “Combo Deals” or “Exclusive Deals”, which include custom design and development services.
As this refund policy is clearly outlined and agreed to at the time of purchase, we do not tolerate chargeback threats or actual chargebacks raised with your card provider or payment processor. If a chargeback is submitted, we reserve the right to report the incident to credit reference agencies, chargeback databases, or other relevant entities, which may negatively impact your credit score. The reported information may include your name, email address, billing address, transaction amount, and date. To be removed from such listings, you will be required to repay the chargeback amount in full.
6. Ownership and Licensing
a. Our Content: All Platform content, including designs, tools, and software, remains our intellectual property and may not be copied, shared, or modified.
b. Licence to You: We grant you a non-transferable, non-exclusive, revocable licence to use the Platform. You must not copy, resell, or reverse engineer the Platform or any of its content. You may only print or download content for personal use and must retain copyright notices.
c. Founding Members: Founding Members receive lifetime access for the life of the Platform, provided their account remains active and in good standing.
d. Account Holder Content: You retain all rights to your uploaded content (“Account Holder Content”).
By uploading, you:
- Warrant that you own the content or have rights to upload it
- Grant us a licence to store and use it to provide services
- Agree that we may access it to provide support
- Are responsible for ensuring it does not violate third-party rights
- You may revoke our licence by removing your content. Upon cancellation, we may retain a copy of your content for legal or compliance reasons, but it will not be displayed or shared.
e. Limitations on Use & Removal of Content: DEK is only to be used within its own ecosystem. You may not export or use our templates, training, or designs elsewhere. All use is restricted to the Platform. Upon cancellation, all access to designs, training, and calls ends. We are not liable for any loss of content.
f. Use of Testimonials: By submitting testimonials, feedback, or content featuring your likeness, you grant us a licence to use it for marketing and training purposes. You confirm you are over 18 and the owner of all submitted materials.
7. Code of Conduct
You agree not to:
- Use DEK for unlawful activity
- Reverse engineer the Platform
- Host client accounts under your DEK account
- Share or sell your login or content
- Upload offensive, defamatory, or infringing content
- Spam users or engage in bulk emailing
- Discriminate or harass others
Violation of this Code may lead to account suspension or termination at our discretion.
8. Data Policy & Legal Compliance
You agree to comply with all applicable laws including UK GDPR, the Data Protection Act 2018, PECR, and other UK and international privacy laws. You confirm that you have obtained all required consents to use personal data on the Platform.
You release DEK from any claims related to your misuse of personal data, including unauthorised sharing, failure to obtain consent, or breach of privacy laws.
9. Our Rights
We reserve the right to:
- Suspend, alter, or remove Platform features at any time
- Remove users or content without notice
- Access your account to provide technical support
- Retain server copies of content for legal or backup purposes
By continuing to use DEK, you agree to any future changes to these Terms, which we may update at any time.
10. Third Parties
We may link to or integrate with third-party services. We are not liable for the performance or accuracy of third-party websites or services. Your use of those services is governed by their terms.
11. Payment Processing
We currently integrate with Stripe and PayPal. You agree to their terms when using their services. You must ensure compliance with your local business, tax, and regulatory requirements.
12. Errors & Interruptions
We do not guarantee error-free performance or uninterrupted access. Features may change or be temporarily unavailable for maintenance.
13. Limitation of Liability
DEK is provided "as is" without warranties. We are not liable for indirect, incidental, or consequential losses. Our liability is limited to fees paid in the last 12 months. This does not affect your statutory rights under UK law.
14. Indemnification
You agree to indemnify DEK against claims arising from:
- Your use of the Platform
- Content you upload
- Data or privacy breaches
- Violation of any law or third-party rights
This indemnity survives the termination of this agreement.
15. Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales. All disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. You agree to resolve all disputes individually and waive any right to participate in class actions.
16. Entire Agreement & Severability
These Terms constitute the entire agreement. If any provision is found invalid, the rest remain in full force. No failure to enforce any provision constitutes a waiver.
